CBP Clarifies Management Consultant TN Visa Requirements

In a recent upstate New York AILA liaison meeting, U.S. Customs and Border Protection (USCBP) officials clarified the requirements for TN visa status as a Management Consultant. Several immigration attorneys had reported that some USCBP officers were requiring both a bachelor's degree and proof of five years experience in the field to qualify as a Management Consultant.

The TN visa regulations, however, provide eligibility for a TN as a Management Consultant based on either a bachelor's degree or five-years of experience. USCBP confirmed that an applicant may provide either a bachelor's degree or proof of five-years experience to qualify under this TN visa category.
