On June 9, 2008, the comment period ended for the proposed rule that would extend TN visa status from one to three years. USCIS will now review the comments received from the public and determine if it should make any revisions to the proposed rule. After this analysis, USCIS will publish the final rule with implementation dates in the Federal Register. The publication date has not been determined.
Prior to any rule proposal, USCIS is required to prepare an assessment of the benefits and costs anticipated to occur as a result of the regulatory action. The assessment prepared by USCIS for the three year TN rule proposal has recently been published. See Regulatory Impact Analysis for TN Rule.
