TD Visa – Canadian Citizens
Process for TD Visa Status for Citizens of Canada.
1. No Visa Stamp Requirement:
Citizens of Canada are generally exempt from the visa stamp requirement and therefore do not need to first file for a non-immigrant visa stamp at a U.S. consulate or embassy prior to seeking entry to the U.S. Thus, the Canadian citizen spouse and children of a TN visa worker may obtain TD visa status directly at a U.S. port-of-entry.
2. Accompanying TN Visa Worker:
If the spouse and children of the TN visa worker are at the port-of-entry at the same time the TN visa worker seeks admission to the U.S. under TN status, then the spouse and children are eligible for TD status as accompanying dependents and may receive their TD visa status simultaneously with the principal worker's receipt of TN status.
In order to obtain TD visa status, the spouse and/or children must present:
- Proof of Canadian citizenship (in most cases a Canadian passport, which is now generally required for admission); and
- Proof of relationship to the principal TN applicant, such as a marriage certificate (spouse) or birth certificate (children).
3. Following to Join TN Visa Worker:
If the TN visa worker is already present in the U.S., his/her spouse and children may still obtain TD visa status independently at the U.S. port-of-entry as following-to-join dependents. Since the TN visa worker is not present during the application for TD visa status, in addition to the above basic items, applicants for TD visa status as following-to-join dependents should have on hand evidence of the principal worker's TN visa status approval and evidence that the TN visa worker continues to maintain his/her status. The additional documentation would include:
- Copy of the TN visa worker's valid I-94.
- Recent letter from TN visa worker's employer and/or recent pay-stubs.
4. Approval of TD Visa Status:
Following review of the TD dependent's documentation, the inspecting officer will issue each dependent an I-94 under the classification symbol TD for the same period as the principle TN visa professional.
