NAFTA TN Status Definition: Dual-Intent

The concept of “dual intent” allows certain non-immigrants to retain non-immigrant status even when they have submitted an application for permanent residence or where an employer has filed an application for a labor certification or employment-based immigrant petition on their behalf. See 63 FR 1331 (Jan. 9, 1998).
