Green Card Applications May Now Be Filed For TN Visa Workers By Same-Sex Spouses

Following the U.S. Supreme Court's decision holding the Defense of Marriage Act (DOMA) as unconstitutional, USCIS has announced that U.S. citizens and lawful permanent residents may now file green card applications on behalf of their same-sex spouses.

This means that TN visa workers may now be sponsored for green cards by their same-sex spouses. According to a FAQ recently posted by USCIS, the agency will consider a same-sex marriage as valid for immigration purposes as long as the marriage is recognized in the state where the marriage took place.
